1. Acceptance of Terms
By accessing or using Pitchd (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all users, including visitors, registered users, and subscribers.
2. Description of Service
Pitchd is an AI-powered proposal generation tool that helps freelancers and agencies create professional client proposals. The Service uses artificial intelligence to generate document content based on information you provide. All output is generated automatically and should be reviewed before use.
3. Not Legal or Commercial Advice
Pitchd is a document generation tool only. Nothing produced by the Service constitutes legal, financial, or commercial advice. All proposals generated are starting points - you are solely responsible for reviewing, editing, and approving any document before sending it to a client. Pitchd accepts no liability for the outcome of any proposal sent to a third party.
4. User Accounts
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate information when registering. Pitchd reserves the right to suspend or terminate accounts that violate these terms or that are used fraudulently.
5. Subscriptions and Payment
Access to proposal generation requires an active paid subscription. Subscription fees are billed in advance on a recurring basis. All fees are non-refundable except as set out in our Refund Policy. Pitchd reserves the right to change pricing with reasonable notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
6. Acceptable Use
You agree not to use the Service for any unlawful purpose, to generate fraudulent or misleading documents, to impersonate any person or entity, to attempt to circumvent any usage restrictions, or to reverse-engineer the Service or its underlying AI systems. Pitchd reserves the right to terminate access for any user who violates these restrictions.
7. Intellectual Property
You retain ownership of all input data you provide to the Service. You own the proposals generated using your data. Pitchd retains all rights to the Service itself, including its software, design, and AI systems. You may not copy, resell, or redistribute the Service or its underlying technology.
8. Limitation of Liability
To the maximum extent permitted by law, Pitchd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of business, lost revenue, or failed client engagements. Our total liability to you shall not exceed the amount you paid for the Service in the three months preceding the claim.
9. Modifications to the Service
Pitchd reserves the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes where possible. Continued use of the Service after any modification constitutes acceptance of the updated terms.
10. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
